A cognitive test can identify candidates who are likely to learn quickly, solve unfamiliar problems and handle complex information. It can also create risk if it is chosen poorly, administered inconsistently or treated as the only answer to a hiring decision. So, do cognitive tests discriminate? Not inherently. But the way an assessment is designed, selected and used can either support fair hiring or produce outcomes an employer cannot justify.
For Australian employers, this is more than a technical question. Recruitment processes must be defensible under anti-discrimination obligations, practical for candidates, and strong enough to improve quality of hire. The objective is not to avoid useful data. It is to use it carefully, in a way that is relevant to the role and fair to the people applying.
Do cognitive tests discriminate by design?
Cognitive ability tests measure capabilities such as verbal reasoning, numerical reasoning, abstract reasoning, problem-solving and learning agility. The adjustment should preserve what needs to be assessed, rather than create an unnecessary hurdle.
4. Scores are used as a blunt pass-fail gate
Cognitive scores are most useful when interpreted alongside other relevant evidence. A candidate’s skills assessment, structured interview, work sample, experience and qualifications can each add information that a reasoning test cannot provide.
Using a single cut-off score to reject large numbers of applicants is tempting in high-volume recruitment. It is also where organisations can create avoidable risk. A cut-off should be linked to the level of capability needed for competent performance, not set simply to reduce the shortlist. In many cases, score bands and combined decision rules provide a more balanced approach than an inflexible pass-fail threshold.
A practical framework for fair use
Employers do not need to choose between predictive hiring and inclusive hiring. They need a disciplined selection process that makes both priorities visible.

Finally, combine the results with structured evidence. A structured interview can test how a candidate has applied judgement in comparable situations. A work sample can show whether they can complete a core task. Skills testing can confirm technical capability. Cognitive testing adds a valuable signal about reasoning and learning potential, but it should not be expected to answer every hiring question.
Monitor outcomes, not just individual scores
Validation is not a one-off procurement exercise. Employers should review how their process performs over time. Are test results associated with later training outcomes, quality measures or supervisor ratings? Are candidates from particular groups progressing at materially different rates? Is the assessment helping hiring managers make better decisions, or merely producing more data?
Where group differences appear, investigate before assuming either that the tool is flawed or that the result is unavoidable. Review the job relevance of the assessment, the pass mark, candidate communications, testing conditions and the other hurdles in the process. The issue may sit in the test, but it may also sit in the way the selection funnel has been designed.
This monitoring is particularly valuable for government, healthcare, education and large-volume employers, where repeated hiring produces enough data to spot patterns. Smaller organisations can still take a proportionate approach by documenting the rationale for their assessments, reviewing rejected and successful candidate profiles, and seeking specialist advice when introducing high-stakes screening.

High applicant numbers increase the pressure to automate early decisions. They do not remove the need for judgement. A better model uses cognitive assessment to prioritise review, supported by job-relevant thresholds and additional selection evidence.
